Terms of Service

These Terms of Service ("Terms") govern your access to and use of ForSaleAmerica.com and our state-specific domains (collectively, the "Sites"), operated by Kildare Business Services, LLC ("we," "us"). By accessing the Sites or submitting a form, you agree to these Terms. If you do not agree, do not use the Sites.

1. What we are

We are a real-estate marketplace and information service. On forsalegeorgia.com, we operate as a licensed real-estate brokerage affiliate; on every other state-specific domain, we operate as a marketplace that connects you with licensed real-estate professionals in your state.

2. Automated valuation estimates

Property valuations shown on the Sites (including the "low," "mid," and "high" estimates returned after you submit a request) are automated estimates based on public data and recent comparable sales. They are not appraisals, broker price opinions, or comparative market analyses. They are notguarantees of sale price. The actual sale price of a property depends on its specific condition, market conditions at time of sale, and the terms of any sale agreement, none of which our automated estimate accounts for.

For a valuation that accounts for the specific condition of your home and current market dynamics in Georgia, you should request a comparative market analysis from a licensed real-estate professional, which we can arrange at your request.

3. Your responsibilities

• You will provide accurate information when you submit a form.
• You will not submit information about a property unless you are the owner of that property, an authorized representative of the owner, or you have the owner's permission.
• You will not use the Sites for any unlawful purpose, including submitting fraudulent inquiries.

4. Prohibited uses

You agree not to:

• Scrape, mass-download, or systematically extract data from the Sites.
• Probe, scan, or test the vulnerability of any system or network.
• Use any automated means to submit forms, including bots, scripts, or credential-stuffing tools.
• Impersonate another person or misrepresent your affiliation.
• Interfere with or disrupt the Sites or any network connected to them.

5. Intellectual property

The Sites, including all content, code, design, and trademarks, are owned by Kildare Business Services, LLC or our licensors. You may view and use the Sites for personal, non-commercial purposes. You may not copy, modify, distribute, or create derivative works from the Sites without our prior written permission.

6. Disclaimer of warranties

THE SITES AND ALL CONTENT ON THEM ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KILDARE BUSINESS SERVICES, LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SITES OR ANY AUTOMATED VALUATION SHOWN. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SITES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

8. Indemnification

You agree to indemnify, defend, and hold harmless Kildare Business Services, LLC and its affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from or related to your breach of these Terms.

9. Governing law and dispute resolution

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-laws principles. Any dispute arising from or related to these Terms will be resolved in the state or federal courts located in Forsyth County, Georgia.

10. Changes to these Terms

We may modify these Terms from time to time. We will post the updated Terms at this URL and update the "Effective date" above. Your continued use of the Sites after we post updated Terms constitutes acceptance of the updated Terms.
