This Privacy Policy explains how Kildare Business Services, LLC ("ForSaleAmerica," "we," "us") collects, uses, and shares information when you visit ForSaleAmerica.com or any of our state-specific domains (collectively, the "Sites") and when you submit a request through one of our forms.

1. Information we collect

• Information you provide. When you submit a home valuation, cash-offer, agent-match, or mortgage request, we collect the address you provide, your name (if provided), your email address (if provided), your phone number (if provided), and your stated timing for any potential sale.
• Information collected automatically. We collect your IP address, user-agent string, the URL of the page from which you submitted the form, and the timestamp of submission. We use this information for fraud prevention, audit, and to maintain a defensible TCPA consent record.
• Cookies and similar technologies. We use a limited set of first-party cookies for session continuity and rate-limiting. Cloudflare Turnstile may set a session cookie on the form pages for bot challenge.

2. How we use information

• To process your home valuation, cash-offer, agent-match, or mortgage request.
• To contact you by phone, text message, and email regarding your submission (see "Outbound calling and SMS" below).
• To route your submission to a participating real-estate agent or partner.
• To maintain a record of your consent to marketing communications.
• To comply with legal obligations and respond to lawful requests.

3. Third-party data enrichment

When you submit a request, we may use third-party data services (including BatchData) to look up additional contact information associated with the property address you provide, such as the most recent owner of record and any associated phone numbers or email addresses. We do this so that we (or a partner agent) can contact the appropriate party about your request, even when only a property address is submitted.

You consent to this enrichment when you submit one of our forms with the consent block visible. You may revoke this consent at any time by emailing [email protected].

4. Outbound calling and SMS

By submitting a form with the consent block visible, you provide your prior express written consent to receive marketing calls, autodialed calls, prerecorded messages, and text messages from ForSaleAmerica.com (Kildare Business Services, LLC), our affiliated brokerage in your state, and our marketing partners at the phone number you provided, including via automated technology. Consent is not a condition of any purchase or service. Message and data rates may apply.

You can revoke consent at any time by replying STOP to any text message or emailing [email protected]. We honor opt-out requests promptly and in any event within ten (10) business days, as required by the Telephone Consumer Protection Act (TCPA).

5. Sharing with marketing partners

We may share your submission information (including enriched contact information per Section 3) with one or more participating real-estate agents, brokerages, or partners who fulfill your request in Georgia. We do not sell your personal information for cash compensation. The list of partners changes over time and is not published in this policy; if you wish to know which partners have received your information, contact us at [email protected].

6. Retention

We retain submission information indefinitely for legal-hold purposes (TCPA litigation defense). We retain third-party-enriched data for 24 months after your last interaction with us, unless you convert into a customer or successful transaction, in which case the standard records- retention term applies.

7. Your rights

Depending on your state, you may have rights under the California Consumer Privacy Act / California Privacy Rights Act (CCPA/CPRA), the Virginia Consumer Data Protection Act (CDPA), the Colorado Privacy Act (CPA), or similar laws, including the right to know what information we hold, the right to deletion, the right to correct inaccurate information, the right to opt out of "sales" or "sharing" of information, and the right to non-discrimination for exercising these rights.

8. Children's privacy

Our Sites and services are not directed to children under the age of 16, and we do not knowingly collect information from children under 16. If you believe we have inadvertently collected information from a child under 16, please contact us immediately at [email protected]and we will delete it.
